What is a Restrictive Covenant (RC)?
A restrictive covenant is defined as a legal instrument placed on title to control how the land can be used or developed in the future. It is a private contract between homeowners collectively, or between homeowners and a developer or builder. RCs run with the title, which means if the property changes hands, the RC remains on title and the new owner is expected to follow it. RCs are not new; they have been around for over a century in Calgary, and they can cover everything from physical attributes of a home, such as architectural guidelines, or use of the lot, such as single family home only. Many communities have long-running RCs on title that remain today.
